Conference 2020
We have not made a decision to cancel this year’s Conference; however, we will not hold Conference if we cannot ensure a safe environment for all participants. For now, we will continue to monitor the direction and guidance from the governor and health officials. We will continue to provide updates as we move forward.
Delegate Election for Conference 2020/Officer Elections
Given the current restrictions on group gatherings, we have consulted with our legal representatives to ensure that we provide accurate information regarding the process of electing delegates and chapter officers. Delegate and Officer Elections are outlined in OSEA’s Constitution and also must comply with the LMRDA (Labor Management Reporting and Disclosure Act). The LMRDA has issued guidance for labor unions stating that so long as a union acts in good faith, delays a legally-required election for good cause connected to the COVID-19 pandemic and reschedules the election in a timely manner, it will not take enforcement actions against that union.
Ratification of Agreements
Contract ratification votes are not subject to oversight or enforcement. The parameters of such votes are governed solely by the union constitution and bylaws although federal law does through Title 1 of the LMRDA guarantee members an equal opportunity to have a voice and to cast votes in ratification elections conducted by their union. Based on the above, the OSEA Board of Directors has approved chapters reaching agreements by vote of officers provided members receive a copy of the agreement and notice that the vote of membership will take place at a fixed date in the future.
Guidance
In light of the current pandemic, restrictions on travel and assembly, and concerns about the process of creating new and different procedures that may conflict with or require amendments to OSEA’s and chapters’ constitutions and bylaws, the Board has decided to delay the election of officers and ratification votes until a fixed date in the future. In the interim, as appropriate OSEA’s Board or chapter leadership will be authorized to take action on behalf of the union.
